Below you will find the General Terms and Conditions of Sale, the delivery and return procedure. The Terms apply to the sale of all products. This informs you:
- how Magnificence delivers the products,
- how you can change or terminate the sale,
- what to do if a problem occurs or other important matters when purchasing the products.
By placing the order you agree to these terms and conditions. If you do not agree with these terms and conditions, please do not place any order by the website. The conditions can be changed at any time. The new version of the Terms will apply to any offer or order placed on the website after the new version has been announced. For that reason, you are advised to ensure that you are satisfied with the terms and conditions each time you place an order.
1. INFORMATION RELATING TO MAGNIFICENCE AND HOW TO CONTACT MAGNIFICENCE Magnificence is a company in the Netherlands. The number of the Chamber of Commerce is 78233305. Magnificence is located at Hofnar 2, 5554 DA Valkenswaard, The Netherlands. You can contact Metabletica through customer service. For the time being, this can only be reached by email: info@magnificence.nl or info@magnificence.beauty. If Magnificence contacts you, we will do so by telephone or email.
2. PRODUCTS The images of the products on the website are for illustrative purposes only and while every effort is made to represent the colors as accurately as possible, the colors of a product shown cannot be guaranteed to accurately reflect the actual color of the product. The products may differ from these images.
3. CONTRACT
3.1. Magnificence did accept your order from the moment an order confirmation is sent to you by email. At that time, a purchase-sales- agreement of the ordered products will be concluded between Magnificence and yourself. If Magnificence is not able to accept your order, Magnificence will inform you by email and the products will not be charged. This can be the case when:
- the product is no longer in stock;
- Magnificence has identified an error in the price or description of the product;
- you have exceeded Magnificence’s purchasing policy as described below;
- Magnificence has to deal with technical problems with the product or make minor technical adjustments;
- Magnificence must adapt the product to integrate changes in relevant legislation and regulations.
Magnificence cannot handle orders to a PO Box address. When Magnificence accepts your order, you will see a confirmation page, which will provide you with a unique reference number and the total amount deducted based on your payment method. You can either print this page or wait until you receive this information in the confirmation email. The email contains all details regarding the purchased product, the delivery address and the delivery and packaging options. Please note that the contract is in the language of the order and that it will be archived for a period equal to the perixod required to fulfill the purposes for which it was archived. If you have any questions about an order, please contact customer service using the contact details stated in article 1. It helps if you can provide the order number each time you contact Magnificence regarding an order.
3.2. Price and payment
The price of the products is indicated during your online visit, either visible in the shopping cart on the banner at the top of the website, or on the checkout page when you place an order. If there is a change in the VAT rate between the date of order and the date of delivery of the products, Magnificence will adjust the VAT rate, unless you have already paid for the products in full before the change took place. Magnificence takes all reasonable steps to ensure that the price advised is correct. In the unlikely event that the products display an incorrect price, Magnificence will contact you to receive instructions before accepting your order. If Magnificence accepts and processes an order where the error in the price is clear and unambiguous and could reasonably be recognized by you as a mistake in the price, Magnificence can terminate the contract, with full payment and return to Magnificence of the delivered undamaged product. You can pay for the products by using the following payment options:

IMPORTANT INFO: For your security and to avoid fraudulent transactions, your billing name and address must match that of the chosen payment method.
3.3. Cancellation of an order
Sometimes an order or part of it is canceled by the Magnificence system. There could be a number of reasons for this:
- The product is not available;
- There are difficulties in processing payment information;
- The impossibility to deliver to the indicated address;
- A duplicate order was placed
If your order is canceled by Magnificence, you will receive an email with the reason for this. The full amount will then be refunded. If you wish to change or cancel the order before shipment, please inform customer service via email. Please state your order number. Orders are processed in 2 working days and shipped within 3 working days. As a result, it may be impossible to stop the delivery after all. In this case, you must return the product in question upon receipt.
4. DELIVERY
4.1. Standard Delivery Magnificence offers free delivery on all orders for an amount of € 50,- (fifty) or more. For an order under € 50,– (fifty) we charge € 4.50 (four euros and fifty cents) shipping costs. Delivery to the address specified by you in your order, usually within 3 to 5 business days from the date your order was accepted by Magnificence. Working days are understood to mean Monday to Friday, excluding holidays. Please allow two additional working days for delivery in rural areas. If the supply of your products is delayed due to events beyond Magnificence’s control, you will be contacted as soon as possible to notify you and Magnificence will take steps to minimize the impact of the delay. Magnificence will not be liable in this case for delays caused by those events. All orders require a signature on delivery. If you are not present to receive your order, the carrier will leave contact details and a delivery card so that you can make other arrangements. In order to ensure a safe and undamaged delivery, the carrier will not leave your delivery “hidden” at the delivery address unless you have specifically notified the carrier. If after a failed delivery you do not make other arrangements for transport or do not collect the products from the delivery depot, Magnificence or the carrier will contact you for further instructions and storage costs and any other delivery costs will be charged. If, despite our reasonable efforts, we are unable to contact you or arrange for another delivery or collection, Magnificence may terminate the contract and you will be liable and liable for damages.
4.2. Delivery addresses
Unless you provide other guidelines during the ordering process, Magnificence will deliver the purchased products to the address specified in your account.
Magnificence will take all reasonable care to deliver the goods to the specified address. However, Magnificence will not be liable for non-delivery or erroneous deliveries as a result of incorrect data provided by you.
4.3 Ownership and Responsibility
You are responsible for the products from the moment they are delivered to the address specified by you. You own the products once Magnificence has received full payment.
5. RIGHT TO TERMINATE THE CONTRACT
You have the right to terminate your contract with Magnificence and return the products, but that right to terminate the contract will depend on the products purchased, on whether you have simply changed your mind, on whether something does not match the products that Magnificence delivered, how the contract was performed and when you decide to terminate the contract. If you wish to terminate the contract by doing something that Magnificence would have done or something that Magnificence was told it would do, see clause 5.1. If you wish to exercise your right of withdrawal, see article 5.2. You can get a refund if you are in the “cooling-off” period, but the refund may also include a reduction in payment. If what you have purchased is faulty or incorrectly described, you have a legal right to have the product replaced or to receive a partial or full refund. See article 5.3.
5.1 Terminating the contract due to something Magnificence has done or will do If you cancel the contract for any reason described below, the contract will terminate immediately and Magnificence will refund you in full for any product not delivered. The reasons are:
- Magnificence has notified you of an error in the price or description and you do not wish to proceed; There is a risk that the provision of the products will be significantly delayed due to events beyond Magnificence’s control;
- Magnificence has interrupted the supply of the products due to technical reasons, or Magnificence informs you that Magnificence will interrupt for this reason, or You have a legal right to terminate the contract due to something that Magnificence has done wrong.
5.2 Right of withdrawal
Magnificence hopes that you are happy with your order, but if for any reason you are not completely satisfied or you change your mind, you as a consumer have a legal right of withdrawal and the right to a refund within fourteen (14) days after the products were delivered to you, or in the event that the products were delivered in parts, within fourteen (14) days after the last part was delivered. You must notify Magnificence of your intention to exercise your right before the end of this fourteen (14) day period, via email to Magnificence customer service expressing your decision to exercise your right of withdrawal, and you must return the products and other items received for free within fourteen (14) days for a refund. You have no right of withdrawal for products whose hygiene seal or other similar protection has been damaged or manipulated. This also applies to products whose sealing seal(s) has been opened. You cannot return the packaging due to your damaged packaging. you also cannot exercise your right of withdrawal when purchasing products:
- whose price depends on fluctuating rates in financial markets over which Magnificence has no control; • that are specifically manufactured according to your instructions;
- that have already been delivered and are inextricably linked to other products.
5.3 If there is a problem with the product
Please inform Magnificence immediately after delivery of any damage or defect or incorrectly delivered products or if the products appearing on the invoice do not correspond to those in your delivery. Products with broken seals cannot be returned. You can do this by emailing Magnificence customer service at info@magnificence.beauty or info@magnificence.nl with your order details. To ensure quick processing, please provide your order number and return the box, packaging, all items received for free and the undamaged products to Magnificence BV, Hofnar 2, 5554 DA Valkenswaard, The Netherlands. Magnificence has a duty to you to deliver products that are in accordance with the contract and that do not contain any hidden defects. Please note that if you return products more than fourteen (14) days after the delivery date, there will be no refund of the amount paid. If you wish to exercise your legal right to refuse products, you must return these products together with the items received for free. Please ensure that you have proof of return when you return the products to Magnificence. You must keep this proof in order to provide Magnificence with proof that you have returned the products and all items received free of charge if Magnificence does not receive the returned products.
6. HOW TO RETURN
If you have the right to return products pursuant to article 5, you can return them to Magnificence, Customer Service, Hofnar 2, 5554 DA Valkenswaard, the Netherlands. You will find a return label in the packaging with information about your order and the return address. Any refund will be excluded if the value of the products has decreased due to the way you have processed them and which would not be allowed in a store.
a) Returning products
Products and additional items must be returned promptly to Magnificence Customer Service. If you return products because you exercise your right of withdrawal, the products and additional items must be received by customer service within fourteen (14) days after you have informed Magnificence that you exercise that right, in order to maintain your right to a refund. Please make sure that the returned package is properly sealed. If you return the package, ask for a proof of shipment. Please keep the return receipt to provide Magnificence customer service with proof that you have returned the products if customer service does not receive the returned products.
b) Refund Processing
If you have returned your products because you have exercised your right of withdrawal, Magnificence will process the calculated refund as soon as possible and in any case within fourteen (14) days from the day on which customer service has received the returned products or (if earlier) on the day on which you provide us with proof that you have returned the products to customer service. Magnificence will not be obliged to make the refund if you cannot prove that the products and all additional items have been returned. You must therefore ensure that you keep and present the return receipt. Please note that a full refund will not be granted if the products show signs of unreasonable use. Refunds will only be made to the original payment method that was made before the purchase. You will receive a notification from customer service via email regarding the refund.
7. OBLIGATION OF MAGNIFICENCE
If Magnificence fails to comply with these terms or fails to exercise reasonable skill and care in dealing with you, Magnificence will be responsible to you for foreseeable loss and damage caused to you. Loss and damage are foreseeable when it is clear that it will occur, or when both Magnificence and you knew it could occur at the time of contract conclusion. Magnificence only supplies products for private use and not for commercial use and resale. Magnificence therefore cannot be held liable to you for any loss of profit, loss of business, business interruption or loss of commercial opportunity.
8. PERSONAL DATA
Magnificence will use the personal data you provide to:
(a) deliver the products to you;
(b) process your payments;
and (c) keep you informed of similar products offered by Magnificence if you have agreed to this during the delivery process (you can always contact customer service to cancel this option). Magnificence will only provide your personal data to third parties under the conditions set out in the data protection policy. For information on how Magnificent will use your personal data, please refer to the data protection policy.
9. OTHER IMPORTANT MODALITIES
Magnificence may transfer rights and obligations under these terms to another person or organization. If Magnificence does so, you will be notified in writing and Magnificence assures you that such transfer will not affect your rights under the Agreement. You may not transfer your rights or obligations under these terms to another person unless Magnificence agrees to do so in writing. Magnificence will not unreasonably refuse to do so or delay it for an unreasonably long time. Only you and Magnificence are parties to this agreement. Consequently, no one else can derive any rights from this agreement.
These provisions operate independently of each other, so the illegality or unenforceability of one of them does not affect the other provisions. The other provisions remain applicable in this case. The fact that Magnificence does not immediately insist on the performance of your obligations under these provisions or if Magnificence ceases to take action when you commit a breach of contract, it still means that you must fulfill your obligations under these provisions and prevents Magnificent from not to take action at a later date.
These provisions are governed by International law. Legal proceedings should be brought before the appropriate courts or alternatively from existing dispute settlement organizations.
